NZ VISA Digital Gift Card Terms & Conditions

1. General
  1. For the purposes of these terms and conditions (“Terms”), “You” refers to the purchaser and/or recipient and user of the Digital Gift Card, being a gift card that is in a digital form and available in the iGo platform. 
  2. Digital Gift Cards are issued by IGO GROUP (NZ) LIMITED NZBN: 9429051288716 (“Issuer”). The Issuer has all rights in relation to the iGo eGift Card Platform and the Widgets (“iGo Platform”). The Issuer uses ASB as an authorised deposit-taking institution and is a member of Visa. 
  3. The Issuer is the distributor and promoter of the Digital Gift Card. Issuer is also responsible for providing certain cardholder services to You, including providing You with Your Digital Gift Card and assisting You with any enquiries You may have regarding the use of a Digital Gift Card. 
  4. A separate contract is created between You and the Issuer on these Terms for each Digital Gift Card You hold. 
  5. Purchasing or using a Digital Gift Card means that You accept these Terms.  
 2. Using a Digital Gift Card
  1. Digital Gift Cards are redeemable at retailers with contactless payment facilities or online merchants which support Apple Pay or Google Pay and accept Visa (some retailers may not accept Digital Gift Cards). 
  2. Digital Gift Cards are for personal use and must not be resold.  You are responsible for registering and activating your Digital Gift Card on the iGo Platform. The Issuer is unable to provide a replacement card if the Digital Gift Card has not been registered.   
  3. If You are sending the Digital Gift Card as a gift, You are responsible for ensuring the accuracy of Your recipient’s details at the time of purchase. The Issuer accepts no liability for a Digital Gift Card delivered to a recipient due to incorrect details provided by You.  
 3. Issuing, activating and using a Digital Gift Card 
  1. In order /or to activate a Digital Gift Card, You must: a) have a mobile device which supports Apple Pay or Google Pay; b) be in New Zealand with location services enabled on your mobile device; c) provision the Digital Gift Card to Apple Pay or Google Pay and accept the terms and conditions of the iGo product; and d) agree to any applicable terms of use, privacy policy and/or any other terms of Apple Pay or Google Pay. 
  2. Digital Gift Cards may be subject to a number of security checks in accordance with internal compliance processes. Following completion of those security checks to the Issuer’s satisfaction, a Digital Gift Card will be issued and activated within 48 hours. Once issued and activated within a person’s iGo platform, a Digital Gift Card cannot be transferred or re-assigned. 
  3. When making a payment using your Digital Gift Card you may be required to enter your PIN into the merchant’s terminal or enter your mobile phone security credentials (e.g. PIN, passcode or biometric identifier) on supported devices to complete a transaction. The ‘Credit’ option will automatically apply to all transactions which may result in a surcharge by the merchant. 
  4. You are responsible for ensuring that all information you provide to the Issuer in connection with the Digital Gift Card is accurate and complete. If the Issuer has reason to believe that any information provided by you is false or misleading, it may suspend or cancel the Digital Gift Card and any associated services with immediate effect.  
  5. All transactions conducted in a foreign currency will be converted into New Zealand dollars. Transactions will either be converted directly into New Zealand dollars or will be first converted from the currency in which the transaction was made into US dollars and then converted to New Zealand dollars by Visa Worldwide Pte Ltd (“Visa”). The conversion rate used is either: a) a wholesale market rate selected by Visa from the range of wholesale rates available in wholesale currency markets for the applicable processing date, which may vary from the rate Visa receives; or b) the government-mandated rate in effect for the applicable processing date. 
  6. A currency conversion fee of 3.5% is payable and deducted from the Digital Gift Card available balance when you make a transaction on Your Digital Gift Card in a currency other than New Zealand dollars. A currency conversion fee may also be payable if You make a transaction on Your Digital Gift Card in any currency (including New Zealand dollars) that is processed by a card scheme or financial institution or billed by the merchant outside of New Zealand. You should check where the processor is located before completing a transaction as it may not always be clear, particularly when purchasing online, that the merchant, financial institution or card scheme processing is located outside of New Zealand. 
  7. The Digital Gift Card is not a cash substitute. You have no rights to, and You agree that You will not attempt to: a) redeem a Digital Gift Card for cash; b) reload it ; c) return it for a refund; d) have balances of multiple Digital Gift Cards consolidated to a new Digital Gift Card; e) use a Digital Gift Card for cash withdrawals (including at ATMs); (f) authorise transactions that exceed your Digital Gift Card’s available balance or g) use a Digital Gift Card for cash equivalent transactions (such as bill payments, purchase of financial products or foreign currency or gambling transactions).  
  8. Digital Gift Cards may be subject to use restrictions, including limitations on offline transactions and restrictions on certain categories of purchases such as gambling and other high risk merchant categories. They may not be accepted by all retailers or merchants. Digital Gift Cards cannot have a negative balance.  
  9. Digital Gift Cards provided by a business as part of its employee rewards programme may be reloaded by the business at its discretion, subject to the Issuer’s applicable business terms. You cannot reload the card. If you are interested in providing a reloadable Digital Gift Card, please email help@ igodirect.co.nz.  
  10. The Digital Gift Card must not be used for any illegal or fraudulent purpose or any purpose which breaches any applicable laws or regulations. Any misuse of the Digital Gift Card may result in its suspension or cancellation. 
  11. If You breach these Terms, You agree that, in addition to other available remedies, the Issuer may suspend or cancel your Digital Gift Card and/or block a transaction. 
 4. Validity Period
  1. Digital Gift Cards are valid for the period advertised on the Digital Gift Card, being created and outlined on the email containing the Digital Gift Card is delivered, and will expire on the date indicated on the face of the Digital Gift Card as shown in the iGo Platform. 
  2. After the Digital Gift Card has expired, it is no longer valid and all transactions will be declined. You agree that You have no right to receive a refund of any unused value remaining on the Digital Gift Card following its expiry and that unused value will become the Issuer’s property immediately following the expiry date unless the Issuer elects otherwise. 
5. Mobile Wallets
  1. In order to use a Digital Gift Card, You must have a device which supports Apple Pay or Google Pay (together, “Mobile Wallets” and each, “Mobile Wallet Provider”). If You do not have a supporting device, please email help@igodirect.co.nz. The Issuer may, in its sole discretion, cancel your Digital Gift Card and instead provide You with a replacement physical gift card of the same value, which may be subject to other terms and conditions presented to You at the time it is provided to You. 
  2. In addition, to use a Digital Gift Card, You must agree to any applicable terms of use of Your Mobile Wallet Provider’s terms and conditions, privacy policy and/or any other applicable terms. 
  3. To the greatest extent permitted by law, the Issuer is not responsible for and disclaims all liability associated with the use, functionality, availability, error or defect of the Mobile Wallets, any eligible Apple or Android device, or any failure or refusal of merchants or retailers to process transactions with a contactless payment terminal (either in-store or online).  
  4. You agree that the Issuer: a) (where Your Digital Gift Card is registered with Apple Pay) may exchange information with Apple related to the set up and use of Apple Pay and Your Digital Gift Card. By using Apple Pay, You agree that: i) Apple can provide the Issuer with information, such as your Apple device details, for purposes including providing customer support, detecting and managing fraud, and to comply with applicable law and regulations; and ii) the Issuer can provide Apple with information including information about Your transactions for the purpose of operating and generally improving Apple Pay. Apple’s data collection and handling practices are in accordance with their privacy policy (available at Privacy – Apple (NZ)). b) (where Your Digital Gift Card is registered with Google Pay) may exchange information with Google and service providers related to the set up and use of Google Pay and Your Digital Gift Card. By using Google Pay, You agree that: i) Google can provide the Issuer with information, such as your Android device details, for purposes including providing customer support, detecting and managing fraud, and to comply with applicable law and regulations; and ii) the Issuer may provide Google and its service providers with information (including transaction information) for the purpose of operating and generally improving Google Pay. Google’s data collection and handling practices are in accordance with their privacy policy (Privacy Policy – Privacy & Terms – Google).  
  5.  Apple, Apple Pay, and associated trademarks are owned by Apple Inc. and are registered in the United States and other relevant jurisdictions. Google and Google Pay are trademarks of Google LLC, registered in the United States and other relevant jurisdictions. All other trademarks mentioned belong to their respective owners.  
6. Security and Lost and Stolen Mobile Devices or Cards 
  1. You agree to keep your mobile device and security credentials safe and secure in the same way You would with a physical card and PIN. You also agree to maintain and keep all software on Your mobile device up-to-date in accordance with the directions of Your mobile device’s manufacturer. 
  2. Digital Gift Cards should only be given to the intended recipient for use and not shared with other users. You remain responsible for keeping the Digital Gift Card safe and not unattended in locations where it is likely to be accessed or removed without consent. Unauthorised use of a Digital Gift Card will not be reimbursed unless the Issuer determines otherwise.  
  3. You acknowledge and agree that any delay or failure to report a lost or stolen device to the Issuer may result in a Digital Gift Card being used without Your consent. If you have not registered your Digital Gift Card, the Issuer may be unable to stop, cancel or replace the card unless the Issuer is able to verify your ownership. If Your device is lost or stolen, or You suspect an unauthorised transaction has been entered into, You must immediately report this by emailing help@igodirect.co.nz. 
  4. The Issuer may at its discretion issue You a replacement Digital Gift Card in certain circumstances. Any replacement Digital Gift Card will have the same unused value of the original Digital Gift Card (as at the time of replacement, less any replacement fees) and the same expiry date. You must present the original order confirmation or recipient email.  
  5. If you have notified the Issuer in accordance with these Terms, you will not be liable for any unauthorised transactions that occur after you have reported the Digital Gift Card as stolen or lost.  
  6. The Issuer may subject replacement Digital Gift Cards to verification and security checks in its absolute discretion. 
7. Cancellation and suspension 
  1. The Issuer may cancel or suspend a Digital Gift Card with immediate effect if: 
  2. It believes that You have misused, fraudulently obtained or used for illegal purposes the Digital Gift Card; 
  3. You breach any of your obligations under these Terms; 
  4. Suspension or cancellation (as applicable) is required by law or to comply with any regulatory obligation or request; or 
  5. The Digital Gift Card program is discontinued or withdrawn from the market for any reason. 
  6. The Issuer reserves the right to amend, suspend or withdraw the Digital Gift Card programme at any time.

9. Privacy

The Issuer shall manage your personal information in accordance with the privacy policy at https://igodirect.co.nz/privacy-policy/ 

10. Intellectual Property

All patents, trademarks, service marks, trade names, registered and unregistered designs, copyrights (including software rights), database rights, mobile application design and functionality, design rights, rights in confidential information, and any other intellectual property rights (whether registered or unregistered) relating to the Digital Gift Card and the iGo Platform remain the exclusive property of the Issuer. Nothing in these Terms grants you any ownership or interest in the Issuer’s intellectual property.  

11. General
  1. The information in these Terms is current as at the date stated at the beginning of this document. The Issuer may change, add to or delete the terms and conditions in these Terms at any time. 
  2. If the Issuer makes any such change, changes will be published at https://igodirect.co.nz/digital-visa-tcs/. Changes will take effect immediately upon publication on this website unless stated otherwise or where further notice is required by law. Your continued use of the Issuer’s services after any changes constitutes acceptance of the updated Terms. 
  3. The Issuer reserves the right to assign or transfer any of its rights or obligations under these Terms to another party without prior notice. You must not assign or transfer any of your rights or obligations under these Terms to any other person (except when sending a Digital Gift Card free of charge to another individual as a gift or with the Issuer’s prior written approval).  
  4. Digital Gift Cards are not legal tender, account cards, credit cards or debit cards or securities, and are unable to process refunds.   
  5. The Issuer is not liable for the availability, quality or fitness for purpose of any goods or services purchased with a Digital Gift Card. Any dispute about goods or services purchased with a Digital Gift Card, including any mistaken transactions or refunds, must be resolved with the retailer where the transaction was completed. All refunds for goods and services purchased with a Digital Gift Card shall be subject to the discretion of the retailer.  
  6. Except for rights which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by law, the Issuer’s liability in all circumstances is limited to replacing Digital Gift Cards. 
  7. You agree to indemnify and hold harmless the Issuer, its directors, officers, employees and agents from and against any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising out of, or in connection with, your misuse of the Digital Gift Card or breach of these Terms. 
  8. The Terms do not affect your rights under the Fair Trading Act 1986 or the Consumer Guarantees Act 1993. The Issuer does not provide refunds if You change your mind or where the balance has been used (in full or in part), except to the extent required by law.  The Issuer reserves the right to decline refund requests that are beyond the scope of its statutory obligations.  
  9. To the fullest extent permitted by law, if any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect. Any failure or delay by the Issuer to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy. 
  10. These Terms are governed by the laws of New Zealand. By purchasing a Digital Gift Card, you irrevocably submit to the exclusive jurisdiction of the courts of New Zealand for the resolution of any dispute, claim, or proceeding arising out of in connection with these Terms.
